Tinted windows lead to DUI arrest for actor Anthony Mackie

There are many factors that can go into a person's arrest for DWI. Most often, we think of a person driving in some manner that would lead a police officer to believe he or she was intoxicated. Smaller traffic infractions, however, can also lead to drunk driving charges as a recently celebrity arrest shows.

Actor Anthony Mackie, who has appeared in "The Hurt Locker" and "Gangster Squad," was pulled over in New York City on Saturday when police noticed the tinted windows on his vehicle. Once they began to interact with him, however, the accusations became much harsher.

Police said Mackie smelled of alcohol and his eyes were watery and bloodshot. They administered multiple field sobriety tests, all of which Mackie apparently failed. The actor refused to allow police to test his blood-alcohol level. As we discussed two weeks ago, his license will be suspended because of that.

Refusing to submit to a breath test in New York can leave a person facing some of the consequences of a drunk driving conviction before he or she has actually been convicted. While this may not seem right, it is the way things work in New York. To protect yourself from further penalties, however, it is important to know that you can challenge a drunk driving charge.

You do not have to simply accept a DUI charge and live with the penalties. Sometimes police get it wrong -- whether you weren't intoxicated or they failed to follow proper procedure. If either of these is the case, your name should be cleared.
