New York man faces harsh penalties for repeat DWI charge

Someone who has been drinking and makes the decision to drive might feel they have no other option to get where they need to go. When this occurs, the driver is usually very careful to obey traffic laws to avoid drawing attention to the vehicle. For one man, allegedly running a red light has landed him in trouble with the law.

The 40-year-old man was stopped by law enforcement officials at around 3:00 in the morning after running a red light at the Sunrise Highway Service Road and Howells Road intersection. Officers say he was driving while intoxicated. The man, who has previous DWI convictions, was under a driver's license restriction that required him to have an ignition interlock device, which prevents the vehicle from starting if the driver is drunk. Police say he violated that restriction.

The man has been charged with operating a vehicle without an ignition interlock device, felony aggravated and unlicensed operation of a motor vehicle, and felony DWI. He was taken to the Third Precinct to await arraignment on the charges.

Felony DWI charges have harsh penalties in New York. This man is facing the possibility of a driver's license revocation, as well as jail time and fines. Depending on his exact charge, he could be facing a minimum fine of at least $1,000 if this is his second offense in a decade or up to $10,000 if it is his third or higher offense in a decade just for the DWI charge alone, according to the NYSDMV publication "You and the Drinking Driving Laws."
