New York man sentenced on drunk driving charge in fatal accident

For a person who makes the decision to drive after drinking alcohol, almost nothing is worse that getting into an accident. For one man, drinking and driving has landed him in jail for 90 days, but he initially faced a lot more time behind bars. New York residents might be interested in finding out about this case, which took three years to come to a close.

The 38-year-old was initially facing manslaughter and criminally negligent homicide charges before a jury acquitted him of those charges. The man was involved in a drunk driving accident that killed a barber from the Bronx on March 20, 2011. The barber was trying to hail a taxi when he was struck by the man's vehicle. The man initially stopped, but fled the scene after a friend of the victim chased him off. Law enforcement officials caught up with him minutes later and arrested him.

The man, who was allegedly also under the influence of marijuana, was found guilty of driving while drunk. He faced up to a year in jail, but he was sentenced to serve 90 days. He was also ordered to complete three years of probation and a drug and alcohol treatment program. His defense attorney says this is a man who has suffered emotional trauma and that his family suffered as well. The victim's family unsuccessfully asked for the maximum sentence on the drunk driving charges.

While this man wasn't able to avoid a jail sentence, he was able to get a jail sentence that was less than the maximum possible. Those who are facing similar charges should make sure that they understand the charges against them, as well as how to build a strong defense in order to have the best chance at a positive outcome in their cases.
